General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between Chhun Atelier (hereinafter referred to as “we” or “us”) and consumers or entrepreneurs (hereinafter referred to as “customers”) via our online shop at chhunatelier.com.
1.2 By placing an order, the customer accepts these GTC. Deviating terms by customers are not valid unless explicitly agreed upon in writing.
1.3 For consumers, these GTC apply in accordance with the German Civil Code (BGB). For entrepreneurs, the provisions of German commercial law also apply.
2. Conclusion of the Contract
2.1 The presentation of products in our online shop does not constitute a legally binding offer but rather an invitation to order.
2.2 By clicking the “Order Now” button, the customer submits a binding offer to conclude a purchase contract.
2.3 We will confirm receipt of the order immediately via email. The purchase contract is only concluded when we explicitly confirm the order or ship the goods.
3. Prices and Payment
3.1 All prices are stated in Euros (€) and include the applicable statutory VAT. Shipping costs are shown separately during the ordering process.
3.2 The following payment methods are available:

• PayPal
• Bank Transfer
3.3 The customer is obligated to provide accurate payment details. In case of a chargeback or non-payment, we reserve the right to seek reimbursement for incurred costs.
4. Delivery and Shipping
4.1 Delivery is made to the shipping address provided by the customer.
4.2 Shipping times are displayed on the product page and during the ordering process. Delays may occur due to force majeure or factors beyond our control.
4.3 If the customer is a consumer and the goods are lost or damaged during shipping, we bear the risk. For entrepreneurs, risk passes to the customer upon handover to the shipping provider.
5. Right of Withdrawal (for Consumers)
5.1 Consumers have the right to withdraw from the contract within 14 days without giving any reason, as per § 355 BGB.
5.2 To exercise this right, customers must inform us via a clear statement (e.g., by email) sent to chhunatelier@outlook.com.
5.3 The withdrawal period starts from the day the customer receives the goods.
5.4 The customer must return the goods within 14 days of the withdrawal notice. The customer bears the return shipping costs unless otherwise agreed.

6. Warranty and Liability
6.1 Customers have statutory warranty rights for defective goods under §§ 434 ff. BGB.
6.2 Claims for damages are excluded unless they are based on intentional misconduct, gross negligence, or breach of essential contractual obligations.
6.3 For entrepreneurs, the warranty period is limited to one year from delivery, unless otherwise agreed.
7. Retention of Title
7.1 All goods remain our property until full payment is received.
7.2 If the customer resells the goods before payment is completed (applicable for entrepreneurs), any resulting claims are assigned to us.
8. Data Protection
8.1 We collect, process, and store personal data exclusively in compliance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

9. Governing Law and Jurisdiction
9.1 Contracts between us and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 For consumers, mandatory provisions of the country in which they reside remain unaffected.
9.3 The place of jurisdiction is Berlin, Germany, provided the customer is a merchant, legal entity under public law, or has no general place of jurisdiction in Germany.
10. Final Provisions
10.1 Should any provision of these GTC be or become invalid, the remaining provisions shall remain unaffected.
10.2 We reserve the right to amend these GTC at any time. Changes will not apply to existing contracts unless explicitly agreed.
